More on Miers

Controversy from an unexpected source.

Far-right conservatives are still leery of Harriet Miers as a Supreme Court justice. The prominent catch phrase among them is "another David Souter".

Bush is trying hard to reassure them that Miers is a "strict constructionist". This phrase has become coded language for "anti-abortion"; the feeling among right-wing conservatives is that Roe vs. Wade came about as a result of legal interpretation beyond the bounds of the Constitution itself (drawing upon historical and international precedent).

Personally, I'm a little tired of Republicans throwing around this "strict constructionist" thing. If you really want to be called a constructionist, you should strictly interpret the First Amendment, which states that Congress shall make no law respecting an establishment of religion... like, for instance, a law that puts the words "under God" into the Pledge of Allegiance. Or how about the tenth amendment, which establishes states' rights, in contrast to the current administration's attempt to undermine Oregon's assisted-suicide law via a federal mandate. And don't even get me started on Terri Schiavo.

If you really believe in the Constitution, you don't get to pick and choose which parts you decide to enforce.

Anyway, Democrats are promising a thorough examination of Miers during her confirmation hearings, but are otherwise lying low and letting Republican squabbling take center stage. Wow, maybe the Democratic Party is finally learning a few things.
